Statutory Declarations and Affidavits in Singapore

A formal written statement, declared or sworn in front of the right officer. Which officer that is depends on where the document is going, and it changes the cost.

A statutory declaration is a written statement that you formally declare to be true. An affidavit is the same idea, sworn rather than declared, and usually for use in court proceedings.

Which officer you need

If the document will be used in Singapore, a Commissioner for Oaths is usually sufficient, and costs less. If it is going overseas, it needs a notary public. See which do I need if you are unsure, or send us the document and we will tell you.

Exhibits

Where the declaration refers to attached documents, bring them. They are marked and identified as part of the process, and doing it afterwards means making the declaration again.

It is a serious document

A statutory declaration is made under statute and there are consequences for declaring something untrue. The officer will ask you to confirm you understand that before you sign, which is not a formality.

How we help

How we help

Establish which officer it needs

Notary or Commissioner for Oaths, decided by where the document will be used. It is the commonest and most expensive thing to get wrong.

Take the declaration properly

Including confirming that you understand what you are declaring, which is a real step rather than a formality.

Mark and identify the exhibits

Attached documents are dealt with as part of the process. Adding them afterwards means starting again.

Flag wording you should not be signing

If the draft asserts more than you can stand behind, better to deal with it before you swear to it.

Questions people ask

Which officer do I need?

For a document used in Singapore, usually a Commissioner for Oaths. For one going overseas, a notary public. See our page on the difference if you are unsure, or send us the document.

Declaration or affidavit?

Broadly, one is declared and one is sworn, and affidavits are generally for court proceedings. The appointment itself is similar.

Do I bring the attachments?

Yes. Exhibits are marked and identified as part of making the declaration.

What if I am unsure whether something in it is accurate?

Raise it before signing. There are consequences for declaring something untrue, and amending the wording beforehand is straightforward.

Tell us what you need signed

Send the document and what it is for. We will tell you which officer it needs, what it costs, and when you can come in.
